10. ONLINE INSTANT WIN PRIZE WINNER SELECTION AND CONFIRMATION:
Each of the Online Instant Win Prizes will be time stamped (with a predetermined time during the Contest Period) and the first person who uses a Play on (or immediately after) a predetermined time stamp (as determined by the Sponsor in its sole discretion on the basis of its official records) will be deemed the potential winner of an Online Instant Win Prize. The odds of winning an Online Instant Win Prize will change throughout the course of the Contest Period as Online Instant Win Prizes are claimed, and will depend on the number and timing of eligible entrants who use Plays. The total number of Online Instant Win Prizes available to be won will decrease throughout the Contest Period as they are claimed. Any Instant Win Prizes not claimed will not be awarded.
If you are deemed to be a potential Online Instant Win Prize winner, then you will instantly be presented with a pop-up page with a description of the Online Instant Win Prize (the “Instant Win Pop-Up Page”), a mathematical skill-testing question, and will be asked to provide your complete street address, province, and postal code. If you correctly answer the skill-testing question, a pop-up page will display along with information regarding claiming your Online Instant Win Prize.
By accepting an Online Instant Win Prize, the applicable winner: (i) confirms compliance with these Rules; (ii) acknowledges acceptance of an Online Instant Win Prize as awarded; (iii) releases the Contest Parties and their respective affiliates, and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Online Instant Win Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet, and on the winners’ list.
If a potential Online Instant Win Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to complete the Instant Win Pop-Up Page (as determined by the Sponsor in its sole and absolute discretion); and/or (b) cannot, or is unwilling to, accept the Online Instant Win Prize as awarded (for any reason); then he/she will be disqualified (and will forfeit all rights to an Online Instant Win Prize) and such Online Instant Win Prize will not be awarded. If a potential Online Instant Win Prize winner fails to provide a correct address on the Instant Win Pop-Up Page (as determined by the Sponsor in its sole and absolute discretion) or the prize is undeliverable for any reason, the Administrator or its designated representative may make one (1) attempt to contact the potential Instant Win Prize winner via the email address provided at the time of registration. If the potential Instant Win Prize winner does not reply within ten (10) business days; then such potential Instant Win Prize winner will be disqualified (and will forfeit all rights to the Instant Win Prize).
11. GRAND PRIZE WINNER SELECTION AND CONFIRMATION:
On or about September 5, 2017 (the “Draw Date”) in Ottawa, Ontario at approximately 12:00:00 ET, the Administrator will perform a random draw (the “Grand Prize Draw”) from among all eligible Entries received during the Contest Period and the first selected entrant will be deemed the potential Grand Prize winner. The odds of winning the Grand Prize will depend on the number of eligible Entries received during the Contest Period.
The Administrator or its designated representative will make a maximum of three (3) attempts to contact the potential Grand Prize winner via the email address provided at the time of registration within ten (10) business days from the date of the first attempted contact to the potential winner. BEFORE BEING DECLARED THE CONFIRMED GRAND PRIZE WINNER, the potential Grand Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid which will be administered over the phone; (b) sign and return within ten (10) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Grand Prize as awarded; (iii) releases the Releasees from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet, and on the winners’ list. If the potential Grand Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents, within the specified time; and/or (c) cannot accept the Grand Prize as awarded (for any reason); then he/she will be disqualified (and will forfeit all rights to the Grand Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate potential winner from among the remaining eligible Entries received during the Contest Period (in which case the foregoing provisions of this section shall apply to such new potential Grand Prize winner, with the necessary amendments).
The Grand Prize winner’s travel companion must (i) reside in Canada, (ii) have reached the age of majority in their province/territory of residence by the time the Grand Prize takes place, and (iii) travel on the same itinerary as the Grand Prize winner.
